I like the idea of what they're doing there.  But this, not so much:

"By submitting...content... you agree ... (iii) that Clif Bar is thereby granted a royalty-free, perpetual, irrevocable, unrestricted world-wide nonexclusive license to use, reproduce, create derivative works from, modify, publish, edit, translate, adapt, transform, distribute, transmit, broadcast, perform and display such User Content in any media or medium, or any form, format, or forum now known or hereafter developed."

Its not like the pictures were doing anything on my camera.  I'm not loosing anything by "gifting" it to Clif.

My first thought was that I'd submit a pic of myself doing something I considered  notable.  But I have had second thoughts since doing so would give them permission to "modify, publish, translate, adapt, transform, distribute, transmit, broadcast, perform, and display... in any media or medium....".

Not that they'd want to use pics of me anyway :), but still ...

Correct me if I'm wrong but is that now what is happening here at Trailspace.  Does not Trailspace have all the rights you mentioned with the content & pictures we post here as well?

I'm just making a persona comment here, not as a mod: 

Gentleman, how do you propose the use-rights for something like this be worded, and do you have the legal knowledge to know that what you would propose has veracity? 

Without being able to use the images you submit, the Cliff Bar charitable program is impossible, and without granting them the use right, they can't do so. 

It's like saying you will give someone an old bike, but refusing to let them take it out of your garage.

I shall respectfully agree with both points of view.

Everyone should be aware that when they share content online (words, images, video, etc) they are nearly always granting that site/company the right to use that content (check for Terms of Service).

If they're not comfortable with that, they shouldn't share it. I'm glad Bill brought this up, because I don't believe enough people do think about it in their daily online activities — until it's in their face. But it applies in many more instances.

Many reputable companies have no interest in doing much else with the content you share, but you should be aware when you're granting permission.

Companies absolutely need to have legal control over the content on their own sites though, or it would be virtually impossible to run the site.

From Trailspace's Terms of Service:

By submitting Content to Trailspace for inclusion on the Website, you grant Trailspace an irrevocable, world-wide, royalty-free, transferable and non-exclusive license to use, distribute, reproduce, modify, adapt, publish, translate, create derivative works from, publicly perform and publicly display and distribute such Content (in whole or in part) and to incorporate such Content into other works in any format or medium now known or later developed.

@Gonzan, I think you're right.  Clearly one possible reason for the contest is to gather material that they could use for promotional purposes.  I guess the "compensation" for the submitter is the chance to win a prize.  I'm not even saying it's "wrong", just that I don't care to participate on those terms. I'm not pretending in any way to be a legal expert - though the Clif Bar terms seem quite clear even to a legal lay person such as myself.

@Apeman, I wasn't sure about the terms here on Trailspace, so I just checked the ToS.  You're right, the same terms regarding user-submitted content exist here.  I guess that gives me something to think about...   But honestly I don't feel the same level of concern here.  Trailspace provides a free service that I value on multiple levels.  So I don't mind supporting the site, just the way I don't mind wearing a Trailspace hat on the trail, or plastering Trailspace stickers on my gear, knowing full well it's blatant advertising.  I want this site to continue.  Also (and importantly), having interacted for the past 5 years with those who run this site, I've developed a level of trust that they won't "misuse" content I've uploaded, particularly likenesses of myself.  I have none of these feelings for "Clif Bar & Company."

Either way, aren't we doing this for the charity of our choice?  Or bragging rights?  Or the goodies TS is offering to those who submit?  All are noble motivations.  Its all just a gift really to the cause we are supporting.

I think bheiser just wants less competition for his forthcomming submission.  Of course I'm kidding here.

@FromSagetoSnow, yep, that's the purpose right now.  But once they have our images they can do anything else they want with them (including advertising for Clif Bar products) anytime now or in the future.

I got a laugh from your comment, so I'm glad you were kidding :).  I'm not trying to discourage anyone from submitting content.  :)

I read what bheiser1 wrote and thought about it.  Yes Cliff is getting something but I see it as a trade.  While reading the Meet the moment site I realized that I wanted to support more of the charities so I submitted a second picture.  

Last April the high school in town had a trip to China and my daughter wanted to go but because she was a bit young I had to, had to, go with her.  This picture was taken about two hours outside of Lhasa Tibet.  We did not climb or do and strenuous activities.  Living under 1000 feet and taking a plan to 12,000 and then driving to over 15,000 can be a bit weird.

I've thought more about this too. I think my initial reaction stemmed from the fact that I wanted to use a photo of myself on an adventure. In fact that's what drove me to check their ToS before posting it. I wanted to see how they might use a photo of me.

While I'd still like to know (and preferably pre-approve) how other (less personal) photos I've taken will be used, my concern for them is far less strong., and varies depending on various factors. For example, if its one that I'm trying to sell then it wouldn't make sense to dilute its value also giving it away such that it can be used freely at some company's pleasure. The bottom line is that If I can find a photo I've taken that I feel would be compelling enough to be useful in the Clif Bar "benefit", and that I don't mind it potentially being used without my knowledge, then I'll probably post it too.

Interesting discussion. Its one I have heard more and more these days across market segments and the internet. Are companies just marketing with these charity driven programs or are they doing good? Or both? I say both. The charities benefit and frankly, I'd rather receive the "marketing impression" via a campaign that benefits a charity than watching an ad on TV.

The terms seem like boiler plate legal speak. Whether it is your credit card terms or terms for a website reading them is bound to creep you out. Or at least it creeps me out. At the end of the day we should all think about how much of ourselves we want to reveal online and proceed accordingly because trying to get something off the interwebs is like trying to get pee out of the pool!

Good question. We sent a query to Clif last week to see if they were done accepting entries, as the www.meetthemoment.com site is still open and they haven't announced a winner yet.

As soon as they're done, we'll draw our own winner from the submissions above. Or, we'll just draw once we hear back and know their timeline.
